On January 10, 2024, the U.S. Securities and Exchange Commission approved the listing and trading of eleven spot bitcoin exchange-traded products, after having denied spot-bitcoin ETF applications for over a decade. Trading began the next day, January 11, 2024, with roughly $4.6 billion in first-day volume. Nuance: The approval followed the D.C. Circuit's 2023 Grayscale v. SEC ruling that rejecting spot products while allowing futures-based ones was arbitrary; then-Chair Gensler's approval statement explicitly disclaimed endorsement of bitcoin. Futures-based bitcoin ETFs had already been trading since October 2021 — "first bitcoin ETF" claims need the spot/futures qualifier.
Common misstatements:
- "The SEC approved Bitcoin." — It approved exchange listing of specific ETP shares; it neither endorsed nor "legalized" the asset.
- "The first US bitcoin ETF launched in 2024." — First spot ETPs; futures ETFs preceded them by over two years.
- Dating approval to January 11. — Approval was January 10; trading started January 11, 2024.
